Chapter 1
Article 3. [Definicje] Whenever the Act mentions:
4) A small architecture facility
Art. 29. 1 – this should be understood as small objects, in particular:
c) utilitarian for everyday recreation and maintaining order, such as: sandboxes, swings, ladders, garbage cans;
1. Does not require a building permit decision,however, it requires notification, referred to in Art. 30, construction:
7) temporary construction structures not permanently connected to the ground and intended for demolition or relocation to another place – within the deadline specified in the notification, but no later than 180 days from the date of commencement of construction specified in the notification;
14) free-standing:
a)single-story farm buildings,
b) garages,
c) shelter
-with a development area of up to 35 m2, where the total number of these facilities on the plot cannot exceed two for every 500 m2 of the plot area;
15) backyard:
a) porches,
b) orangeries (winter gardens)
-with a development area of up to 35 m2, where the total number of these facilities on the plot cannot exceed two for every 500 m2 of the plot area;
16) free-standing single-story individual recreation buildings, understood as buildings intended for periodic recreation, with a building area of up to 35 m2, and the number of these facilities on a plot cannot exceed one for every 500 m2 of the plot area;
20) school fields and sports fields, tennis courts and running tracks for recreation;
21) fences higher than 2.20 m;
22) above-ground home terraces with a building area exceeding 35 m2;
28) small architectural objects in public places;
2. It does not require a building permit decision or the notification referred to in Art. 30, construction:
1) farm facilities related to agricultural production and supplementing farm development within the existing habitat plot:
a) single-story farm buildings with a building area of up to 35 m2, with a structure span of no more than 4.80 m,
2) sheds with a building area of up to 50 m2, located on a plot on which there is a residential building or intended for residential construction, and the total number of these sheds on the plot cannot exceed two for every 1,000 m2 of the plot area;
3) free-standing gazebos with a built-up area of up to 35 m2, where the total number of these structures on the plot cannot exceed two for every 500 m2 of the plot area;
4) allotment gazebos and farm facilities referred to in the Act of December 13, 2013 on family allotment gardens
7) parking spaces for passenger cars up to 10 spaces, except for those located in a Natura 2000 area;
19) small architectural objects, except for small architectural objects in public places;
20) fences with a height not exceeding 2.20 m;
31) above-ground home terraces with a building area of up to 35 m2;

Chapter 8 Greenery and recreational facilities
§ 40. [Place zabaw i miejsca rekreacyjne]
2. The children’s playground should have at least 4 hours of sunlight, counted on equinox days, between 1000 and 1600. In downtown buildings, sunlight exposure is allowed for no less than 2 hours.
3. The distance of children’s playgrounds, sports fields for children and teenagers and recreational places from the lines dividing the street, from the windows of rooms intended for people and from places of waste collection should be at least 10 m, while maintaining the requirements of § 19 section 1.
Chapter 9 Fences
§ 41. [Wymogi dotyczące ogrodzenia]
1. The fence must not pose a threat to the safety of people and animals.
2. Placing sharp elements, barbed wire, broken glass and other similar products and materials on fences at a height of less than 1.8 m is prohibited.
3. The provisions of section 1 and 2 do not apply to internal fences in prisons and detention centers.
§ 42. [Bramy i furtki]
1. Gates and wickets in the fence cannot open to the outside of the plot.
2. Wickets in the fence of multi-family residential buildings and public utility buildings must not impede access to them for disabled persons using wheelchairs.
§ 43. [Wymiary bramy] The clear width of the gate should be at least 2.4 m, and if a wicket is used, its width should be not less than 0.9 m, and on a fire route, these widths are regulated by separate provisions regarding fire protection.
